These Terms of Service ("Terms") govern your access to, and use of, our platform comprised of the website, web applications and mobile applications (collectively, the "Services"). By accessing or using the Wize Up platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to modify these Terms at any time, and such modifications will be effective upon posting. Your continued use of the Services after modifications indicates your acceptance of the revised Terms.
You must be at least 18 years of age to use The Services. By accessing or using the Services, you represent and warrant that you meet the eligibility requirements and are fully able and competent to enter into and comply with these Terms.
The Wize Up platform provides AI-generated summaries of YouTube videos from curated channels across various categories. These summaries are intended for entertainment and informational purposes only. The web and mobile apps include additional features such as subscriptions to specific channels and automatic generation of summaries for new videos.
The content provided through the Services is generated by artificial intelligence and is subject to errors, omissions, and inaccuracies. While we strive to offer useful and engaging summaries, we do not guarantee their accuracy, reliability, or completeness. The summaries are for entertainment and general informational purposes only and should not be relied upon for important decisions, advice, or factual accuracy. By using our Services, you agree to assume all risks associated with the use of AI-generated content.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
• Violate any applicable laws or regulations while using the Services.
• Use the Services for harmful, deceptive, harassing, fraudulent, or malicious purposes.

To access certain features of the Services, you may need to create an account and subscribe to upgraded services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Subscription-based features allow you to receive automatic personalized summaries for new videos from subscribed channels. By subscribing, you authorize us to collect the applicable subscription fees and agree to the terms of payment and billing outlined below.
For subscription-based services, you agree to pay all fees associated with your subscription. Payments are due at the time of subscription and may be automatically renewed unless canceled according to our cancellation policy. Wize Up AI reserves the right to change pricing at any time, and such changes will be communicated to you before renewal.
Services can be canceled at any time for any reason. Cancellations take effect immediately. No refunds are provided for monthly billing subscriptions. For yearly billing, you may request a refund for the unused portion of your subscription by contacting us at support@wizeup.ai. Refunds will be issued to the original payment method.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the collection and use of your data as outlined in the Privacy Policy.
The Services are provided "as is" and "as available," without any warranties of any kind, express or implied, including but not limited to warranties of availability, merchantability, fitness for a particular purpose, non-infringement, or accuracy. Wize Up AI does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Wize Up AI and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Services. This limitation applies even if Wize Up AI has been advised of the possibility of such damages.
The Services may contain links to third-party websites or content, such as YouTube videos. Wize Up AI is not responsible for the content, accuracy, or practices of third-party websites. Your interactions with such third-party content are solely between you and the third party.
We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, and without prior notice. For paid subscription services, if the termination is due to a violation of these Terms, no refunds will be issued for any remaining paid subscription period. However, if the termination is initiated by Wize Up AI for reasons unrelated to a violation, you may request a pro-rata refund for any unused portion of your paid subscription. Upon termination, your right to use the Services will cease immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect.
If your free trial ends and no payment is provided to continue with a paid plan, your account will enter a limited state. You will retain access to your account for 30 days, during which you may select a paid plan and add a payment method to resume service. If no action is taken within this period, your account will be automatically closed and all associated data will be permanently deleted.
Wize Up AI reserves the right to modify, suspend, or discontinue the Services, in whole or in part, at any time and without notice. If a material change to the Services substantially reduces the value of paid subscriptions, affected users have the option to cancel their subscriptions and receive a pro-rata refund for any unused portion. Notification of such changes will be provided in advance when possible. We are not liable for any modification, suspension, or discontinuation of the Services.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, unless otherwise required by applicable law. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA).
Wize Up AI reserves the right to update or modify these Terms at any time. We will notify users of significant changes through the Services or other communication methods. Your continued use of the Services after changes are made constitutes your acceptance of the revised Terms.
These Terms constitute the entire agreement between you and Wize Up AI regarding your use of the Services and supersede all prior agreements, communications, and understandings, whether oral or written.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of Wize Up AI to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision.
